Hopefully the silence is so they don't prejudice whatever they're doing or planning to do. I would be fuming if the little twat is on his full pay.

I suppose it's already been said a few times, but the only talks with Milan that matter are those between Milan and City, not Milan and a fat semi-retired player.

Also, there has to be a line drawn by City. If Tevez gets his cut price move then what's to stop other players letting themselves go and waddling off home in mid-season? City need to be very firm on this issue. He can bugger off for £25 million (or euros) as long as he stumps up the other 15-25 million himself.

So would I but I remember that fiasco with Kaka, when GC & Co tried to do deal using normal, straight business methods & were basically laughed out of central Europe. Now it looks like we're dealing with the same bunch of slimey snakes again, with another even slimier snake in the middle & we're selling them a slimey snake as well. God knows what kind of deals could be brokered amongst that shower.

The irony of it all is they dont speak spanish in Milan and he will be exactly 5 miles further away from his family in Argentina! than he would be if he stayed here. Big fat lying turd!

Since he finally dug himself a hole by going awol, I'm starting to enjoy this whole thing in a more relaxed way. He cannot do anything anymore to hurt City he has shot his bolt. Now it is just waiting and watching as City slowly methodically squeeze the life juice out of him.
I have this vision of a glass tank with some poor rat in it that has been given some nerve gas and is twitching and nutting its head against the glass in ever more desperate and freakish ways. Obviously there is a TV on in the background with a loop of all City's goals from this season.

I do know something about contract and employment law...... and I would suggest that we are probably paying him unless we specifically included clauses in his contract that would address this unusual situation - which I would seriously doubt

The risk here - for either party - would be to do something that could be seen in court to be a breach of contract - CITY will not make that mistake - Tevez 'was' also acting in that manner when he returned to the UK and was 'getting on with it - he just lost the plot.

The PFA were a great help to Tevez in their ruling that basically wiped the slate clean for him - if he could just 'go through the motions' until January.

What will happen (IMO) is:

1/ We will continue to pay, until
2/ We think that the timing is right to hit him with a disciplinary and seek a massive fine - probably with the PFA on our seide this time and
3/ Look for the disciplinary to substantiate a breach of contract - again PFA support (being the legally route for action by both parties) will be important
4/ sell at a reduced fee - but hold back on all payments we can - image rights / bonuses etc
5/ sue him for loss (difference between £40/50m and the actual fee) based on the breach

If we do anything that leaves us open to a breach of contract then he can successfully sue us

It's going to be interesting as clearly we could just sell him cut price and it wouldn't really affect us. However it could have a major impact on other teams and players. We can't keep him and keep paying him and it would affect everyone if players were able to force cut price deals.

That's why UEFA, FIFA and the PFA have been so vocal about all this in offering their leadership. They'd have looked impotent if they'd just said nothing.

Right now we have to wait for circumstances where we can show we honoured all of our obligations, yet he failed to honour his.
And he made or intends to make no attempt to remedy the problem.
But we'll only get damages that reflect what it's actually cost us so it feels like any reduction in the sale price would be fair game provided we do our best to mitigate the loss and not sell to the first bidder. Securing what looks like it could be shown to be a firm bid of 44m Euro from Corinthians looks in hindsight like a master stroke

This would fit in with the way we keep letting it slip out that we value him very highly. Therefore if we are reluctantly forced to sell him to the snakes, because nobody else comes in with a suitable offer, we can say we had no choice but to sell him in Jan as he won't train & is costing us money.

This belated 'fine' though; if he refuses to pay, can the powers that be prevent him from playing until he does ? If he then fucks off home again in a sulk instead of signing for Milan, would we have to sue him for the wages as well ?

Well - you would think not..........

But in contract law it is best for us to do things by the book and at the right time sue for the adjudged losses/damages

Tevez is giving us a list of things that would sway a court of law in our favour - we should not do anything that balances that

As we have already found out - much to our chagrin, the established process for enacting punishment is through the disciplinary process overseen by the PFA - we do not have the latitude to act outside that unless we want to weaken our case when it all goes to court - which seems increasingly inevitable

We only play into there handsw if we also break the agreed contract obligations

This is all going to get very very difficult when he is due to sign for ACM or someone else but refuses to unless we clear everything for him in terms of image rights payments etc and agree not to sue. I am sure (obviously just IMO) that must be Kia's plan - just get us to a point wehere just want rid.

That is when our game plan will be disclosed and I really hope that it is to be tough as fuck - the lawyers I guess might be focussing on this FIFA ruling about the number of games he has to be allowed to play and how to overturn that if he has made himself unavailable

Bottom line is that all the power in these contracts lies with the player and we have to be very careful - frustrating as that is - things will probably change in the future, but...............

I dont want Pato but as someone asked above, where is Tevez these days? Even the reporters seem to have grown tired of him!

Speaking of which such a shame what he did as we could use Tevez the footballer for the coming weeks,,,,
